Patent Information Center (PIC)

Science and Technology, the key instrument for economic advancement has been considered as an indicator of economic growth.

However the footprints of Science & Technology are the Intellectual Property Rights. They reflect the core technological strengths of a country. Maintaining a competitive edge and enhancing the market position are the impacts of IPR. With the advent of new economic policy India has entered the multilateral system of trade. India now needs strict intellectual property system in order to survive in competitive market. A step in this direction was taken by instituting a Patent Information Center (PIC) under the Uttarakhand State Council for Science & Technology, Dehradun (Uttarakhand) with technical and financial support from Department of Science and technology, Govt. of India, New Delhi.

Objective

PIC provides an expert service supporting all aspects of the patenting process. The center basically aims:

  • To create awareness about Intellectual Property Rights (IPRs) and enable universities, Industrial Government Department (R&D) Institutions for patent searches.
  • To analyze the patent information on a regular basis and suggest new programs for R&D institution.
  • Work closely with scientist and attorneys to meet their needs for Patent Information, conducting a variety of patent searches providing a current awareness services and ensuring scientists are informed and support in their use of patent information.

Intellectual Property Right

Intellectual Property is a "A Product of Mind". It is similar to the property consisting of movable or immovable property, which can be used by the owner alone and not lawfully by other without owner's permission. World Intellectual property Organization (WIPO) provides that "Intellectual Property" include rights related to:

  • Scientific, Literary, or artistic fields.
  • Performance of Performing artist, Phonograms, Broadcast
  • Scientific Invention.
  • Industrial Designs.
  • Trademarks, Service Marks and Commercial Names.
  • Invention in all field of human Endeavour and
  • Protection against unfair competition and all other rights resulting from intellectual activity in the industrial scientific, literary or artistic fields

Forms of Protection (in India)

 

  • PATENT: The Patent Act, 1970.The act was last amended in Year 2005.
  • COPYRIGHTS: The Copyrights Act 1957 as amended in 1983, 1984, 1992, 1994, and 1999 and the Copyright Rules, 1958.
  • DESIGN: The Design Act, 1911. A new design Act 2000 has been enacted superseding the earlier Design Act 1911.
  • TRADE MARK: The Trade and Merchandise Marks Act 1958. A new trademarks Act 1999 has been enacted superseding the earlier trade and Merchandise Mark Act 1958.
  • LAYOUT DESIGN OF INTEGRATED CIRCUITS: The semiconductor integrated circuit's layout-design Act 2000.
  • GEOGRAPHICAL INDICATION: The Geographical Indication of goods (Registration and protection) Act 1999.
  • TRADE SECRET ( PROTECTION OF UNDISCLOSED INFORMATION): No exclusive legislation exists but the matter would be generally covered under the Contract Act 1872.

  • UCOST is extensively involved in organizing Patent & IPR Awareness workshops at various places of Uttarakhand including Haldwani, Nainital, Pantnagar, Pauri, Chamoli, Bageshwar, and Dehradun in collaboration with NRDC and TIFAC
  • Regular seminars on IPR and innovation management with collaboration with NRDC, New Delhi
  • Establishing a common platform for scientists/industries/R&D institutions and government offices
  • Center is making efforts through audio/visual/ print media to give wider publicity to IPR and patent in the state

    • Ekaswa-A: Patent application fields in India as published in the issue of the Gazette of India (Part III, Section 2) since January, 1995 onwards.
    • Ekaswa-B: Patent application notified for opposition in the Gazette of India (Part III, Section 2) published since January, 1995 onwards.
    • Ekaswa-C: Patent applications published in official Journal of Patent office published from Jan 2005 to June 2007.
  • Online Search
  • Manual of Geographical indications practice & procedure
  • Manual of Patent Office Practice and Procedure
  • Indian patent office Journal 2005 till date
  • International databases are in the process of being purchased

Services & Conditions

  • Center provide technical and legal supports (through TIFAC's panel of patent attorneys) for obtaining patents and also for post patent in respect of patentable inventions emanating from research funded by:
    • Department of Science and Technology
    • An Indian universities/Educational institution
    • Any other central or State government department/agency
  • Scientist and their institutions are expected to keep track of development in areas related to patented inventions and inform Center about possible exploitation and also violation of their patents.
  • For patentable inventions funded by Universities/educational institution, application for patents will be field in the name of Universities/educational institution with the concerned scientist(s) as investor(s).
  • For patentable information funded by Central/State Govt. agencies, application for patents will be decided by the terms and condition mutually agreed between the funding agency and the research agency.
  • Request for patent search are entertained from scientists, universities/educational institutions, government industry and PSUs with a levy of nominal charges.
  • Queries on IPRs from inventors are quickly responded to.
